Domain registration scam in China

Various companies in China are trying to scare domain owners in other countries into registering Chinese variants of their domain names by claiming some other party was trying to register these variants. Examples of this scam have been reported widely throughout 2008, involving the domains asiaton.cn, erimut.com, erimart.com, erimart-domains.com.cn, hknsc.hk, hongkongnet.org, hk-net.org.cn, hknetwork.hk.cn and others (erimut.com, erimart.com, erimart-domains.com.cn and hknsc.hk are linked by IP address).

Here is one that I received on 2008-12-08, originating from IP 58.38.209.249:

Dear CEO,

We are Asiaton Network Service Co., Ltd, which is the Internet Trademark&domain name register center in China. I have something need to confirm with you. We have received an formal application. An international company named “ROB GmbH” wants to apply “joewein” for its own Internet Trademark and CN domain name on Dec 8, 2008 in china. We need to know your opinion because the Internet Trademark And CN domain name may relate to the copyright of your company name on internet. If your company do not intervene in it,we will formally consent their registration
because the registration principle is that “Every company or individual can register the domain name and Internet Trademark which is not registered, and who registers first who owns first.”
we would like to get the affirmation of your company. If you have any question, please contact us by telephone or email as soon as possible!

Such email solicitations are fraudulent, because you can safely assume that the same email, with other domains substituted for yours, has gone out to thousands of domain owners. I found an almost identical email (listing the same third party supposedly trying to register a domain) in another blog. Somebody obviously thinks being a registrar is a license to milk foreigners.

Don’t fall for this scam, they’re playing on fear.

If you own a .com, .net or national TLD (.co.uk, de., .fr, etc) domain but are not planning to set up a Chinese office or not even doing any business in China you have no reason to spend money on a domain registration with a Chinese registrar. Also, trademarks and domains are largely separate issues. You don’t become a trademark owner merely by registering a domain and vice versa.

The only domains that really count for your business are .com/.net/.org (depending on the nature of your organisation) and/or the country code top level domain (ccTLD, such as .co.uk or .jp) if you’re based outside the USA.

Below are other examples of domain registration spams / scams that I have received before. I am sure there are a lot more out there.

The first e-mail was received April 1st. As you seen, they gave 7 days to answer. There are forwarded messages, they have even sent quotations for registering and for example price for registering brand name is per year, when everyone that has registered his brand knows that you pay once and you have it for ten years.
As for domains, they say the company is interested in the asian domains. They recommend you that, if you don’t have an interest in that market, leave them register and if not, you must register first, being the price double than the ones you find in reliable domain registering companies.
Is it really a scam? My boss requieres me to find out and we reported it to our advisors. But anyway, it makes me feel unsettled, worried.

Thankfully this blog came up among the first search results…

  15. I’ve received kind of a similar email today. I almost trusted it, but luckily I went to Google… The main difference it that all the emails above write about “domain registration” and the email I received is about “international trademark” registration. I Googled “international trademark” and chinese scam, the address, the first sentence of the email and it all led to either nothing of the “domain registration” scam. So that made my decide not to trust it… But be warned now, that next to the “domain registration” scam there’s also an “international trademark” scam going on!

(Please kindly forward to CEO or President who would be concerned about the Trademark and Domains. Thank you.)

After our examination, we found that your company was using the keyword, so we inform you to confirm whether you have authorized Yetta (HK) Co., Ltd to register the keyword International Trademark. If you have authorized, we will finish the registration at once; if not, not to interfere with your business and confuse with your company, please contact us by telephone or email within 7 workdays, and then we will base on your reply to decide our next steps.

Because our company haven’t registered this name as CN domains (.cn/.com.cn/.net.cn/.org.cn) and internet keyword on the internet, anyone can obtain them by registration. You must know the domain names and internet keyword which applied based on the international principle are opened to companies as well as individuals. Also, we have suggested they should choose another name but they are persistent in this name. As a domain name registrar, we have no rights to refuse their application if they insist. In this situation, we have told you your company have the priorty in registering CN domains and internet keyword in our audit period. Could you tell us whether or not your company want to register these CN domain names and internet keyword to prevent anyone from using them?

To avoid such scam, we would suggest domainers/domain Registrants to register/transfer .CN, .HK domain names with Accredited domain Registrars.

To check whether a website/company got accredited or not, the following links for Asian domain Registries would be required

    For .CN Domain Registration:

Now we are handling this registration and after our initial checking, we found the names are similar to your company’s, so we need to check with you whether your company has authorized that company to register these names. If you authorized this, we would finish the registration at once. But if you did not authorize, please let us know within 7 workdays, so that we could handle this issue better. After the deadline, we will unconditionally finish the registration for “TO & MO Co., LTD”. I am looking forward to your prompt reply.

    Dear xxx,

Thanks for your confirmation. As soon as receiving the application of that company, we checked and found “solarim” is your company’s using name and brand. We are concerned that your brand might be affected negatively by their application, this is why we informed you, following Brand Name and domain names are applied for by that company.
    Brand Name:
    solarim
    Domain Names:
    solarim.asia
    solarim.cn
    solarim.co.in
    solarim.com.cn
    solarim.com.hk
    solarim.com.tw
    solarim.hk
    solarim.in
    solarim.net.cn
    solarim.org.cn
    solarim.tw

That company also has the right to apply for the available domain names. For this reason that company is also an licit applicant and we have no right to reject them. Your company only own the preferential right to register these names.

At present, we haven’t passed their application, we need your opinion. If your company consider these names of importance to your company’s business or interest, I suggest that your company register these names first so as to avoid confusion or speculation. If you don’t want to protect your intellectual property rights, then my suggestion is your company give up these names so that we can finish registering for them as per our duty. Please give me your company’s decision as soon as possible in order to handle this issue better.

Thanks for your reply. I reply you as following:
1> If you don’t have any relationship with “CHIYIK Management Group”. According to our working experience, either they invest in domain names, or they do the same business as your client, so to confuse their customers and get profit.
2> We knew you have registered the domain name “festipack.com”, But now “CHIYIK Management Group” wanted to apply for other domain names and Brand Name you have not registered yet. Following are all the domain names and Brand Name which are submitted by “CHIYIK Management Group”:
    Brand Name:
    ——-
    Domain Names:
    —–.asia Asia
    —–.cn China
    —–.com.cn China
    ——.hk Hong Kong
    ——.com.hk Hong Kong
    —-.at Austria
    —–.fr France
    —–.de Germany
    —–.it Italy
    ——-.ch Switzerland
3> Because these domain names seem to have no relation with them, that’s why we send e-mail to inform you. As a domain name registry service organization, we have no right to reject any individual or entity to register these domain names through our body, because domain name registry is open all over the world, “who register first, who own first”. I think you also know that. But it’s our duty and responsibility to avoid this cyber squatting.
Now, what you need to consider is to see whether you need to protect these domain names and Brand Name. If important for, pls inform us in time, so we can apply priority to register for you, and send the dispute application form to you at the same time. Due to time is limited, if you have any question, pls contact me in time. Thanks for your cooperation.

  45. The company where I work gets these emails on average twice a year and each time I reply letting the company who’s contacted know that we’ve previously been contacted and are surprised to discover the domains are still available.

I then proceeded to inform them that I will be forwarding their emails to the Chinese Embassy for their advice on the matter, after that they never ever get back to me.

I also end the email with a little bit about how their venerable ancestors must be ashamed of them and they themselves should be ashamed for involving themselves in such a fraud.
